VICTORY! Supreme Court Upholds Partial Birth Abortion Ban |

U.S. Supreme Court Justice Anthony Kennedy, majority opinion in Gonzales v. Carhart issued 4/18/2007. April 18, 2007. Today, the United States Supreme Court upheld the first federal restriction on a method of abortion since Roe v. Wade. The decision rejected the claims of Planned Parenthood and abortion providers who challenged the Partial Birth Abortion Ban Act of 2003.
Nikolas T. Nikas, Bioethics Defense Fund president and general counsel stated, "Today's decision is a victory for human dignity, constitutional restraint, and common sense." He pointed out that the decision seems to signal the Supreme Court's rejection of unsupported and speculative facial challenges consistently brought by the abortion industry to strike down reasonable abortion regulations.
Bioethics Defense Fund's legal team filed two friend of the court briefs in the U.S. Supreme Court outlining the significant medical risks that the partial-birth abortion method poses to the mother.
Dorinda Bordlee, BDF senior counsel said, "The mask is now off on the abortion industry's ruse of promoting abortion in the name of so-called women's health." Explaining that abortion in general has significant health and psychological risks to the woman, Bordlee also noted that the American Medical Association supported the federal ban on partial birth abortion, explaining that the brutal procedure is "not medically indicated," and is "not good medicine."
"Today's victory shows that with perseverance, prudential judgment and strategic thinking, abortion will continue to be recognized for what it is -- a crime against humanity," concluded Nikas.
